These terms and conditions outline the rules and regulations for the use of Demand Cars Ltd’s services, located at Pantile Farm, Peldon Road, Peldon, Colchester, CO5 7PD.

By signing a vehicle order form or purchase agreement with Demand Cars Ltd, you confirm that you have read, understood, and accepted these Terms and Conditions in full.
1. Your Agreement with Demand Cars Ltd
When you sign the order form, you accept the terms and conditions set out in this Agreement.
Please read this Agreement carefully and ask any member of staff if you have any questions.
Any amendment or addition to this Agreement must be confirmed in writing by an authorised representative of Demand Cars Ltd.
If we agree any variation to the vehicle to be supplied, this shall be deemed an amendment to the Agreement rather than a new contract.
You must provide any information required for us to comply with money-laundering regulations and guarantee its accuracy.
Definitions:

“We” or “Us” means Demand Cars Ltd, the seller of the goods described on the order form.

“You” means the customer purchasing the goods.

“Vehicle” means the goods being ordered and supplied as described on the order form.

2. Credit Checks
When applying for finance or lease products via any of our channels, Demand Cars Ltd may conduct a soft credit search to check eligibility. This will not affect your credit file.
If you proceed to a full application, a hard credit search will be conducted only when you confirm your intention to go ahead with the vehicle purchase and finance agreement.
3. Accessories
Any accessories fitted or supplied by Demand Cars Ltd are covered by the manufacturer’s warranty.
When buying a used vehicle, you are encouraged to check for any missing accessories during the viewing.
Any concerns must be raised before purchase.
After completion, Demand Cars Ltd is not responsible for missing accessories not previously discussed.
4. Customer Responsibility
You must co-operate with Demand Cars Ltd in all matters relating to bookings, provide accurate information, and hold a valid full UK driving licence on the date of any test drive.
5. Vehicle Condition Acknowledgment
Before purchase, the customer has been given the opportunity to inspect and test-drive the vehicle.
By proceeding with the purchase, the customer confirms they are satisfied with the vehicle’s condition, age, mileage, specification, and overall presentation.
Any pre-existing faults, wear, or cosmetic imperfections consistent with age and mileage have been accepted as part of the sale.
🟩 6. Deposit and Cancellation Policy
Deposit Terms
a) A £300 deposit is required to reserve a vehicle. This deposit secures the vehicle and removes it from sale.
b) The deposit is fully refundable within 3 working days, provided you have not viewed and/ or test-driven the vehicle, confirmed the purchase or collection, and the vehicle has not been removed from sale. Where the customer has viewed and/ or test-driven the vehicle in person and the vehicle has been removed from sale and reserved, the deposit shall become non- refundable, except where Demand Cars Ltd is unable to proceed with the sale or the vehicle is materially misdescribed.
c) After 3 working days, the deposit becomes non-refundable, except where:
• The vehicle is withdrawn from sale by Demand Cars Ltd;
• The vehicle is found to be materially misdescribed prior to collection or delivery; or
• The purchase was made entirely online or by telephone, without an in-person viewing or test drive, and you are exercising your 14-day statutory right to cancel under the Consumer Contracts Regulations 2013.
d) In all other circumstances where the customer cancels the purchase, Demand Cars Ltd reserves the right to retain part or all of the deposit to cover reasonable administration costs, advertising costs, vehicle preparation costs, storage costs, and loss of sales opportunity.
e) If a refund is due, it will be processed by bank transfer within 14 working days of written confirmation.
Collection Deadline
f) Vehicles must be collected within 3 working days of paying the deposit unless otherwise agreed in writing by Demand Cars Ltd.
Failure to collect within this period may result in the deposit being forfeited and the vehicle being returned to stock.
Returns under Distance Sales
g) If a vehicle is returned under a valid distance sale cancellation, it must be returned within 14 days, in the same condition, and with no more than 100 miles additional use.
Reasonable deductions may be made for excess mileage (£1 per mile) or diminished value.
h) Vehicle collection or return costs will be charged at £0.60 per mile (including VAT) for the distance between the customer’s address and Demand Cars Ltd’s premises, or at another reasonable agreed transport rate.
7. Ownership and Legal Responsibility
The vehicle remains the property of Demand Cars Ltd until full payment has been received in cleared funds.
You are responsible for any loss or damage from the moment the vehicle is collected or delivered and should insure accordingly.
8. MOT and Service Records
Any MOT or service carried out prior to sale confirms that the vehicle met the required standards on the date of inspection.
Future component wear or faults may occur, and Demand Cars Ltd cannot be held responsible for issues developing after collection unless covered under the warranty terms.
9. Used Vehicles and Warranty
a) A dealer warranty is provided only where expressly confirmed in writing by Demand Cars Ltd. Where a dealer warranty is included, its duration, scope, exclusions and conditions will be set out in a separate warranty document, warranty certificate or warranty booklet issued at the time of sale or shortly thereafter.
b) Unless expressly confirmed in writing by Demand Cars Ltd, no dealer warranty forms part of the contract of sale. The absence of a warranty document or warranty certificate indicates that no dealer warranty has been provided.
c) Where applicable, any manufacturer’s or third-party warranty is separate from, and in addition to, the customer’s statutory rights.
d) Any dealer warranty does not cover faults arising from normal wear and tear, age, mileage, routine servicing, neglect, misuse, accidental damage, corrosion, environmental factors, modifications, or failure to maintain the vehicle in accordance with the manufacturer’s recommendations.
e) Any claim under a dealer warranty must be supported by a written diagnostic report and repair estimate from a VAT-registered garage, and no repair work may be commenced without prior written authorisation from Demand Cars Ltd. Failure to obtain prior authorisation may result in the claim being declined.
f) Nothing in these Terms and Conditions excludes or limits any statutory rights available to a consumer under the Consumer Rights Act 2015 or any other applicable law.
10. Part Exchange Vehicles
Where you sell a vehicle in part exchange, its agreed value will be deducted from the purchase price.
You must own the part exchange vehicle outright or declare any outstanding finance, which must be settled before or during the transaction.
If the condition, mileage, or service history differs materially from what was stated, Demand Cars Ltd reserves the right to adjust the valuation accordingly.
If you delay delivery of the part exchange beyond the agreed date, the valuation may be reviewed based on current market conditions.

11. Vehicle Registration (V5C) and DVLA Processing
Demand Cars Ltd submits all vehicle registration or change-of-keeper applications promptly after sale.
However, Demand Cars Ltd is not entitled to and cannot influence or speed up DVLA processing times.
Once submitted, the application is under DVLA’s control.
Processing times may vary depending on DVLA workload and can take from a few days up to six weeks.

Demand Cars Ltd ensures all required documentation is submitted correctly and promptly but cannot be held responsible for any delays caused by DVLA processing.
12. Road Tax, Fuel, and Insurance
Vehicles are supplied without road tax unless otherwise stated.
It is the buyer’s responsibility to ensure the vehicle is taxed, insured, and fuelled before driving away.
Demand Cars Ltd cannot be held responsible for penalties, fines, or loss resulting from failure to arrange tax or insurance.
13. Taxes, Tariffs, and Statutory Charges
All taxes, tariffs, registration fees, and Vehicle Excise Duty are charged at the rate applicable on the date of purchase.
Telephone calls may be recorded for quality or compliance purposes.
This Agreement is governed by the laws of England and Wales, and the courts of the United Kingdom shall have exclusive jurisdiction.

14. Distance and Off-Premises Sales
a) If you are a consumer and the Agreement is concluded without any face-to-face contact (online or telephone), you may cancel the Agreement within 14 days of delivery under the Consumer Contracts Regulations 2013.
b) To cancel, you must notify Demand Cars Ltd in writing (email or letter).
c) You must return the vehicle in the same condition and specification, with all accessories, documents, and keys, and with no more than 100 additional miles of use.
d) Demand Cars Ltd may make a reasonable deduction for diminished value or use beyond what is necessary to establish the vehicle’s nature and characteristics.
e) The V5C logbook must be returned as soon as received from DVLA, as it forms part of the goods.
(f) Where the V5C registration document has not been received from DVLA at the time the refund is processed, Demand Cars Ltd may retain a refundable £25 V5C security deposit. This amount will be refunded within 5 working days of Demand Cars Ltd receiving the original V5C registration document from the customer.
g) The right to cancel does not apply if you have inspected or test-driven the vehicle before purchase.
h) Refunds will be made within 14 days of receiving the returned vehicle or V5C, whichever is later.
i) If a part-exchange was included, Demand Cars Ltd will either return the part-exchange vehicle or refund its agreed value.
j) If the purchase was financed, you must notify the lender immediately upon cancellation.
k) Vehicle Return Inspection and Deductions:
Upon return, the vehicle will be inspected by Demand Cars Ltd. Where permitted by law, Demand Cars Ltd reserves the right to make reasonable deductions from any refund to reflect:
-
excessive mileage or use beyond that reasonably necessary to inspect the vehicle;
-
damage or deterioration beyond fair wear and tear;
-
missing keys, documents, accessories or equipment supplied with the vehicle;
-
valet or cleaning costs where the vehicle is returned in an unreasonable condition;
-
repair costs resulting from damage or misuse after delivery; and
-
any other reduction in the vehicle’s value permitted by applicable law.
15. Administration Fees
Demand Cars Ltd reserves the right to apply a reasonable administration fee for replacement paperwork, duplicate invoices, or optional services such as private plate handling or extended warranty registration.
16. Entire Agreement
This Agreement constitutes the entire understanding between Demand Cars Ltd and the customer.
No verbal representations, statements, or promises shall form part of this Agreement unless confirmed in writing by an authorised representative of Demand Cars Ltd.
17. Limitation of Liability
Except as required by law, Demand Cars Ltd’s total liability is limited to the purchase price of the vehicle.
We are not liable for any loss of profits, goodwill, or indirect, consequential, or economic losses.
This limitation does not apply to cases involving death, personal injury, or fraud.
18. Data Protection
Demand Cars Ltd is registered with the Information Commissioner’s Office and complies with the Data Protection Act 2018 and UK GDPR.

19. Complaints and Alternative Dispute Resolution
Demand Cars Ltd aims to acknowledge all customer complaints within 5 working days and provide a full written response or resolution within 14 working days, where possible.
